5. Deposit Payment Terms

To secure your booking and confirm an appointment for your visit to the Medical Centers through BizkookTravel.com, a deposit is required. The deposit varies based on different services. This deposit ensures your commitment to the scheduled visit. While legally considered a payment for our services, the deposit will be deducted from the total cost of your treatment. With BizkookTravel.com, you won’t pay more than if you booked directly with the medical providers, wellness providers or tour operators. However, please note that the deposit itself is not considered a payment for the medical services ordered.

The payment for medical services will be based on invoices issued by the respective medical providers, wellness providers or tour operators, in accordance with their terms unless specified otherwise. You can make the deposit using your BizkookTravel.com Account or through a third-party payment provider. Please be aware that using third-party payment services means you are subject to their terms and privacy policies. BizkookTravel.com is not responsible for how these providers handle your personal data.

If you need to request a refund of your deposit, please email us at hello@bizkooktravel.com no later than 14 days before your appointment date. Refunds will be processed within 45 days of your timely request. If you do not meet this deadline, the deposit will not be refunded.

Please note that deposit payments and refunds are not available for Visa or Mastercard holders from the Republic of Cuba, the Islamic Republic of Iran, the Republic of Sudan, the Syrian Arab Republic, and the Bolivarian Republic of Venezuela.

Prepayment Options

In certain cases, and where available, you may choose to make a full prepayment for the medical, wellness or travel services offered by the partners. This option allows you to pay in advance for a specific set of services. The partner will only receive the funds after the services have been successfully provided. Please note that third-party payment providers may be involved in processing these prepayments.

The refund terms outlined above also apply to prepayments made under this option. As with deposits, prepayments and refunds are not available for Visa or Mastercard holders from the Republic of Cuba, the Islamic Republic of Iran, the Republic of Sudan, the Syrian Arab Republic, and the Bolivarian Republic of Venezuela.

All standard message and data charges will apply to any text messages.

If a Health care provider, wellness provider, tour operator or other third party has submitted, uploaded or posted a photograph or video of you on the Site and you want that photograph or video removed from the Site, please contact BizkookTravel.com  at hello@bizkooktravel.com. 14. Liability Limitation; Your Exclusive Remedy

To the extent permitted by law, in no event will BizkookTravel.com  or the BizkookTravel.com  parties be liable to you or to any third party for any indirect, consequential, special, incidental, exemplary, or punitive damages (including, but not limited, to lost profits and damages that result from inconvenience, delay or loss of use) arising out of or relating to the use of the site even if BizkookTravel.com  or any of the Bizkook travel parties have been advised of the possibility of such damages. in addition, in no event shall BizkookTravel.com  be liable to you or to anyone for any decision made or action taken by a party (including, without limitation, by any user or community member) in reliance on any content or other information about health care providers, wellness providers, tour operators, procedures, treatments, or products posted on the site. BizkookTravel.com  shall not be liable for any damages, delays, or non-performance caused by factors or activities beyond its reasonable control, including delays and nonperformance caused by viruses, denial of service attacks, other acts or omission of third parties, internet service provider failures, strikes, lockouts, work slowdowns or stoppages, accidents, fires, terrorism, acts of god, government restrictions, mechanical, electronic or communications failures, war or insurrection.

Notwithstanding anything in these terms, the aggregate liability of the BizkookTravel.com  parties to you in connection with the site (including any third-party content on the site) and these terms will be limited to the amount, if any, paid by you to BizkookTravel.com  in the six (6) months prior to the act that gave rise to the liability, even if BizkookTravel.com  has been advised of the possibility of any of the foregoing types of losses or damages.

16. Applicable law and jurisdiction

In brief: This agreement is governed by the laws of the UAE without prejudice to any consumer rights provided by the laws of your residentship. We intend to settle all disputable issues amicably, but in the event of a serious dispute between us, it shall be settled in the court of the UAE .

These Terms shall be governed by and interpreted due to the laws of the UAE  without prejudice to any consumer rights provided by the laws of your residentship.

If any material or the use of the Website by you does not comply with the laws of your country, the Website is not intended for you, and we ask you not to use it. It is your responsibility to ensure that you know and comply with the laws of your jurisdiction.

You agree that any disputes, conflicts, claims, or disagreements arising directly or indirectly in connection with the Website or these Terms, including, without limitation, those that relate to their validity, interpretation, or application, should be settled by friendly negotiations directly with the BizkookTravel.com  team.

If the consensus is impossible by negotiations, the dispute shall be settled exclusively in a court of the UAE  under the applicable law of the UAE .

You shall make all claims within one (1) year from the date of their origin unless a longer period is required by applicable law.

17. Indemnification

You agree to indemnify and hold harmless BizkookTravel.com  and the BizkookTravel.com  Parties from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or in connection with: (a) your Submissions or any other Content you post or submit to or through the Site; (b) your use of the Site; (c) your conduct in connection with the Site or with other users of the Site, and; (d) any violation of these Terms, any other BizkookTravel.com  policy or of any law or the rights of any third party.

18. Claim Must Be Filed Within One Year; Arbitration; No Class Actions

Any dispute, claim or controversy arising out of or relating to these Terms, BizkookTravel.com  or the Site or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Terms to arbitrate, shall be determined by final and binding arbitration or in small claims court.

If you elect to seek arbitration or file an action in small claims court, you must first send a written Notice of your claim (“Notice”) to us at the address below. Your Notice must describe the nature and basis of your claim and set forth the specific relief you are seeking. If we do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or BizkookTravel.com  may commence an arbitration proceeding or file a claim in small claims court.

Any such Notice must be submitted to us within one (1) year after the claim at issue arose; otherwise, to the maximum extent permitted by law, the claim is permanently barred.

Small claims actions may be filed in the county in which you live. Arbitration hearings shall be held in UAE, Dubai before one arbitrator, but you may choose to have the arbitration conducted by telephone or via written submissions. The arbitration shall be governed by the UAE Arbitration Act and the arbitration shall take place according to the rules of the Emirate Arbitration Association (“EAA”), including the AAA’s Supplementary Procedures for Consumer-Related Disputes. Judgment on the Award may be entered in any court having jurisdiction. Each party shall bear all of its own costs of arbitration except the fee for the arbitrator shall be equally split between the parties. The arbitrator shall not have the authority to modify these Terms or award punitive or exemplary damages to either party. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Seeking any such remedies shall not constitute a waiver of either party’s right to compel arbitration.

Only individual claims may be brought. Class action lawsuits, class-wide arbitrations, private attorney general actions, and any other proceedings where parties act in a consolidated or representative capacity are not allowed. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. 

You also agree that BizkookTravel.com  may bring suit against you in any court of competent jurisdiction solely for injunctive relief to stop any unauthorized use or abuse of the Site, or any infringement or other misuse of intellectual property rights.

20. Our Notices to You; Consent Regarding Electronic Information

You must comply with all applicable laws and third-party terms when using the BizkookTravel.com  App (e.g., your wireless data service agreement or Apple terms). The BizkookTravel.com  App may not contain the same functionality as is available on the Site.

BizkookTravel.com  retains and owns all right, title and interest in and to the BizkookTravel.com  App, including, but not limited, to all rights under copyright, trademark, trade secret, patent and any other proprietary rights. You agree not to modify, adapt, translate, reverse engineer, create derivative works from, decompile, disassemble or otherwise remove any intellectual property notices from the BizkookTravel.com  App.

Apple is not responsible for the BizkookTravel.com  App or any content associated with it. Apple is also not responsible for addressing any claims you make regarding the BizkookTravel.com  App or providing any maintenance or support services for it.

22. Miscellaneous

These Terms constitute the entire agreement between you and BizkookTravel.com  regarding the use of the Site, and supersedes any prior agreements between you and BizkookTravel.com  relating to your use of the Site. The failure of BizkookTravel.com  to exercise or enforce any right or provision of these Terms or any prior version of these Terms shall not constitute a waiver of such right or provision in that or any other instance.
